Pierre Tercier

Professor Pierre Tercier is an Emerite Professor in Civil Law, Contract and Commercial Law at the University of Fribourg, Switzerland.

Tercier graduated from the University of Fribourg (summa cum laude) in 1966. From 1968 to 1970 he was an assistant to Professor Henri Deschenaux at the Faculty of Law at the University of Fribourg; he was admitted to the bar in the canton of Fribourg in 1969. Tercier was an assistant and visiting lecturer in family law at the Faculty of Law at the University of Geneva from 1970 to 1971. He was a researcher at the Max-Planck-Institute in Hamburg for foreign and international private law (1971-1972) and a grantee of the “Max-Planck-Association” and later of the Swiss National Fund for Scientific Research. From 1972 to 1973, he researched and studied comparative law at the University of Cambridge. Tercier was a Professor in Civil Law, Contracts and Commercial Law at the Faculty of Law at the University of Fribourg from 1973, where he was also the Dean of the Faculty of Law (1987-1989). In addition he was a visiting Professor in Construction Law at the Ecole polytechnique fédérale in Lausanne. From 1990 to 1991 he made sabbaticals at Columbia Law School in New York and the Panthéon Assas in Paris. He was a visiting Professor in Swiss and German Law, Contracts and Torts at the University of Paris I in spring 1990, at the University of Geneva for comparative competition law in summer 1990, and at the University of Paris II in spring 1999. In 1999, he also spent a semester at Columbia Law School in New York and at University of Paris IV.

He is the author of a number of books, handbooks and articles.

He is a member of the editorial board of the reviews and publications: Baurecht (construction law quarterly), Schweizerische Zeitschrift für Wirtschaftsrecht (Swiss Review of Business Law), Schweizerisches Privatrecht (Collection of treatises on Swiss private law), Medialex, Revue du droit de la communication (Swiss Review of Communication law).

He was the chairman of the Swiss Cartel Commission since 1989 and a member of said Commission from 1977 to 1996. From 1996 to July 1998, he was the chairman of the Swiss Commission on Competition. In addition, he is a former chairman of the Swiss Insurance Law Society, the Supervisory Authority for the Land Registry of the Canton of Fribourg and a former member of the Banking Commission of the Banque de l’Etat de Fribourg of the Canton of Fribourg. He was appointed by the federal authorities on several occasions as an expert in charge of examining issues dealing with tort law and law of tourism. He was the president of the group of experts in charge of revising the section of the Swiss Civil Code on the protection of individual rights. He is regularly called upon to act as advisor or arbitrator in matters at national and international levels.  He was the President of the Court of Arbitration of the International Chamber of Commerce in Paris and was a militia officer reaching the rank of colonel.
